The appellant, Central Transmission Utility of India Limited, provides transmission services. KSK Mahanadi Power Company Limited (KMPCL), a power generation unit, had entered into a Transmission Service Agreement (TSA) with the appellant's predecessor. KMPCL subsequently underwent Corporate Insolvency Resolution Process (CIRP) initiated on October 3, 2019. KMPCL had made a cash deposit of Rs. 108.44 crores with the appellant prior to CIRP.
