This appeal concerns a suit for specific performance of an agreement to sell agricultural land. The agreement was executed on 18.07.1988, with the sale deed to be executed by 15.12.1988. The time for execution was extended twice, with the last extension up to 30.06.1989. The plaintiff alleged readiness to complete the sale on the last date, but the defendants failed to appear. The suit for specific performance was initially dismissed but decreed for refund of Rs. 2,75,000/-. This was reversed by the first appellate court, which granted specific performance, a decision upheld by the High Court in second appeal. Crucially, the defendants sold 60% of the land before filing an SLP and the remaining 40% during the pendency of this appeal.
