On December 4, 2008, the deceased, Ram Sharan Yadav, was returning home with his brother, the complainant Sunil Yadav (PW-5). They were intercepted by the appellants, Adalat Yadav (A-1) and Anirudh Yadav (A-2), along with others. A-1 allegedly abused the deceased, citing his refusal to heed warnings against deposing in a murder case against Girdhari Yadav. A-1 then shot the deceased, who died instantly. A-2 and others also fired shots. The complainant was shot in the leg. An FIR was lodged the same day.
