The appellant, an engineer, was initially appointed to State Service in 1984 based on a 'backward class' certificate identifying his caste as 'Mallah'. In 1993, he produced a new certificate (Annexure P4) claiming his roots in the 'Majhwar' community, a Scheduled Tribe. An inquiry by the Tehsildar found Annexure P4 to be invalid as it lacked an issue serial number and date, leading to the registration of an FIR in 2004.
