The Appellants, legal heirs of the original plaintiffs, are aggrieved by the dismissal of their civil revision by the Patna High Court. This revision was against an order allowing a miscellaneous case to set aside a compromise decree dated February 22, 1994, in a partition suit. The original partition suit was filed seeking a 1/4th share in ancestral property. A compromise was recorded on February 22, 1994, and a final decree was passed on May 27, 1997. Approximately 25 years later, the respondents (legal heirs of Defendant No. 5) filed a miscellaneous case to set aside the compromise decree, alleging it was obtained by fraud and without the signature of Defendant No. 5.
